A number of vendors have developed "name that tune" technologies that identify audio and audiovisual content by analyzing their unique audio or visual "fingerprints," and then matching them to identical fingerprints in historical databases that they have compiled. Some claim that these technologies can be incorporated into peer-to-peer networks in order to filter out, or require payment for, uses of copyrighted works. We'll examine this controversial technology and its implications for the business models and legal liabilities that will determine the viability of P2P networks. Can fingerprint technologies work in lieu of DRM technologies? Or are fingerprint technologies most effective in identifying copyrighted works before DRM technologies come into play? And once fingerprint technologies identify copyrighted works, how will they interact with the systems that are essential to see that entitled parties are paid the appropriate royalties and residuals? Will the fingerprint and entitled party databases be privately owned by their vendors, or will they be part of a larger copyright registration infrastructure? Join us for insights into what could -- like it or not -- be the future of file-sharing.

As DRM technology makes its way into online content services, various activists, trade associations, and legal scholars have been advocating non-technological approaches to compensating rightsholders for content usage. One is compulsory licensing, such as a flat fee charged to ISP subscribers for unfettered content usage; another is levies, which are like taxes on blank digital media, computers and other types of hardware. Our panelists debate the pros and cons of these approaches, as well as whether they should replace or coexist with DRM.
